Terms and condition

These terms and conditions govern the contractual relationship between Havelock City (Pvt) Ltd and HCM Smiles Loyalty Members.
Havelock City Mall Loyalty Points will not be awarded until these Terms and Conditions have become binding on you.

  • By signing up with the HCM Smiles loyalty program you shall be deemed to have read , understood and accepted the terms and conditions of the loyalty program.
     
  • By enrolling in Havelock City Mall Loyalty program you agree to the collection, use and disclosure of your personal information.
     
  • All registered members will be issued a membership number along with a unique QR code and a barcode. Members can use their QR code/Barcode and the registered mobile number to earn points.
     
  • To earn points from participating retailers, members should present the registered mobile number for the HCM Smiles Loyalty Program.
     
  • Earned points will be credited to the members wallet within 24 hours.
     
  • Point redemption available on point balance in excess of 100 points. Maximum number of points that could be earned per day is 2500.
     
  • Members can contact the Mall concierge for any issues relating to points issuance. All documentary evidence to be submitted such as receipts within 7 days of the transaction. Any decision taken by the mall management in respect of points shall be final and conclusive.
     
  • All points shall be forfeited upon cancellation, or termination of the loyalty program membership and members are not entitled for compensation in respect of any points which are forfeited.
     
  • All earned points will be expired on 31st December in each calendar year. Havelock City Mall Management at its sole discretion may from time to time amend the validity period of the points.
     
  • The Membership is for the residents of Sri Lanka who has a valid Sri Lankan Mobile Number and above 18 years of age. Membership is not extended to minors, corporations, or other legal entities.
     
  • Membership is not transferrable and to be used only by the member.
     
  • Joint accounts and multiple accounts from a single member shall not be allowed. In the event of a duplicate account, HCM reserves the right to merge and consolidate the details of the member to the original account or cancel the membership of both accounts. HCM will not be responsible for loss of points, benefits and other privileges.
     
  • Pooling of points of different members is not allowed and all points required for redemption should be earned by the same member under the same account.
     
  • Havelock City Mall has the right to terminate any membership registration done through mobile application or Web.
     
  • Havelock City Mall has the sole authority to deduct any points that have been credited in error and any points that relate to an eligible transaction which has been cancelled, reversed or relates to a refund given.
     
  • For members who doesn’t have the mobile app, they can view their point balance by logging-in to the Web portal or by contacting the concierge at Havelock City Mall.
     
  • Membership shall be terminated if fraudulent transactions are found.
     
  • Rewards / Prizes / Gifts offered are subject to availability.
     
  • The points required to redeem E-Coupons, Gifts and Gift vouchers are published on the mobile app & Loyalty Web Portal. HCM will have the right to amend the number of points needed for redemption from time to time without giving any prior notice.
     
  • Rewards, Prizes and Gifts are not transferrable, non-refundable, and cannot be redeemed for cash and not for resale.
     
  • Havelock City Mall reserves the right to terminate the Havelock City Mall’s Loyalty program at any time by giving 14 days prior notice. In such a case Havelock City Mall will offer a grace period for redemption of points.
     
  • Havelock City Mall may from time to time send out promotional SMS/ E-Mails as required.
     
  • Havelock City Mall will take all responsible steps to ensure that personal information is protected from aunathorized accesse, misuses, modification and disclosure.
     
  • Havelock City Mall reserves the right to amend the Terms and Conditions of the loyalty program from time to time without a prior notice.

Indemnity

  • You agree to indemnify and keep Havelock City ( Pvt) Ltd, our parent company, subsidiaries, affiliates, officers, directors, representatives, employees, and agents indemnified from and against any liability, loss, claim, dispute, demand, damage or cost (including without limitation legal fees) which arises out of or is caused by your breach of the Terms and Conditions, your use of the app or your violation of any laws or third party rights.

The website www.hcmsmiles.lk is owned and operated by Havelock City (Pvt) Ltd.
 

By using the website, you will be deemed to have accepted these terms and conditions. By accepting the terms and conditions you will be entering into a binding agreement with the company to use the service provided by the HCM Smiles Loyalty program Website of the company.

  • The HCM Smiles website will provide general information relating to HCM Smiles loyalty program, General offers and Coupon Offers, events and promotional details.
     
  • Members can view the existing Loyalty promotions offered by participating retailers in the form of General offers &  E-Coupon offers and can purchase e-coupons in exchange of points.
     
  • To use the purchased E-Coupons from the website, customers should visit the concierge at Havelock City Mall and request for printed coupons from the concierge.
     
  • Information relating to E-Gift Cards and Memorabilia are available on the website and members to seek assistance for redemption at the concierge.
     
  • The website should not be used for any harmful, illegal activity or any other purposes other than what is mentioned in the terms and conditions.
     
  • You must not engage in any misconduct or any activity that will damage, tarnish, interfere or harm the operation and the security of the website.
     
  • The company may from time to time, and without assigning any reasons or prior notice, change the terms and conditions of the website and may from time to time amend or restrict the access to part or all of the website.
     
  • The company may decide to restrict the website to any user who violates the terms and conditions of the website.

The download and use of the mobile application of HCM Smiles Loyalty program is subjected to the terms and conditions stated below.  

By using the mobile app, you will be deemed to have accepted these terms and conditions. By accepting the terms and conditions you will be entering into a binding agreement with the company to use the service provided by the mobile app.

  • The mobile app is only available for the HCM Smiles registered Loyalty Members.
     
  • The mobile app will allow the registered members to access & use the loyalty program, view offers and promotions from participating retailers; purchase and use of e-coupons; view and edit user profiles and check the transaction history.
     
  • The app and its content is only available for personal use and not for commercial purposes.
     
  • The mobile app should not be used for harmful, illegal or any other activity / purpose that are not mentioned in these terms and conditions.
     
  • The company may decide to restrict the mobile app to any user who violates the terms and conditions.
     
  • The company may time to time, without assigning any reasons or prior notice, change the terms and conditions of the mobile app and may from time to time amend, restrict the access to part or all of the mobile app.
     
  • We may collect information of your device from time to time. This information will be used to provide the user a customized and a suitable service. We may use your connectivity strengths and location data to allow the app functionalities such as reward points for visits. Etc.
     
  • We may update the application from time to time, due to various reasons including to maintain the application version upto date with the latest Operating System updates. Terms and Conditions at any time without prior notice may also be updated if deemed necessary. Your continued use of the App after any such update constitutes your acceptance of the updated Terms and Conditions.

HCM Smiles – Membership

  • You are bound to provide true, accurate and up to date information of yourself at the time of registration as a HCM Smiles Loyalty Member.
     
  • Havelock City Mall reserves the right to cancel or deny the access to a profile which is found to contain any falsities, outdated or inaccurate information.
     
  • You are solely responsible for maintaining the login information and you will be responsible for all transactions and activities that occur under your account.
     
  • Once the profile is setup , you have access to the HCM Smiles program and it enables the earning of points at any participating retailer and any accumulated points can be used to purchase E-Coupons, E-Gift Cards, Gifts and Memorabilia and any other method that the company may introduce from time to time to the Loyalty program.
     
  • If you notice any unauthorized activity on your account please notify Havelock City Mall Management immediately on smiles@havelockcitymall.lk or call 0112 590 590.

This page informs you of our policies regarding the collection, use, and disclosure of personal data when you access HCM Smiles mobile app and the website. 

You may note that information may be collected either directly from you when you provide it to us or indirectly including but not limited to when the user navigates through the mobile application & Site, when the user interacts with  us or when the user requests that we contact the user. The information collected automatically may include usage details, internet protocol (IP) addresses, and information collected through cookies, and other tracking technologies such as details your location data, logs, operating systems and browser type etc.

Services of a third party may be obtained to help us gather and analyze information about the areas that the user visits on the mobile application & the site to evaluate and improve the user’s experience and the convenience of the mobile application & the site, and to help us analyze some or all of the information that the user provides to us. If we collect personal information from the user, whether provided to us voluntarily or involuntarily,  the user is giving us permission, to use and disclose that information in any manner desired, including without limitation to contacting the user regarding the Services offered on the Site and the mobile application, to improve or enhance site performance, to communicate to the user about other matters that may be of interest to the user, and to respond to any inquires that the user may initiate. 

We use cookies to store information, such as the user’s personal preferences when the user visits our mobile application and/ or the site. Cookies may track information about the user to enable us to identify the user’s preferences. We also use Cookies to help us understand how users arrive at our Site, browse or use our site. This could include only showing you a pop up once you visit the site. The user can always refuse to allow cookies on their web browser, or the user maybe alerted when cookies are being sent. HCL has the discretion to update or make changes to this Privacy Policy from time to time.  Changes to this policy are effective when they are posted on this page. We encourage the user to review our Privacy Policy regularly for any changes, and it is acknowledged by the user, to review the policy and be informed of updates.

If you do not agree with our policies and practices, you have the option to refrain from using the site and the mobile application. By using this site and the mobile application, the user signifies the acceptance of this Privacy Policy. Continued use of this site and the mobile application after changes in Privacy Policy will indicate acceptance of the updated policies.
